Orange County Dog Bite Attorney

Dog Bite Lawyer Orange County

A neighbor’s dog got through a side gate in Fullerton. A dog lunged at your daughter on a park path in Lake Forest. However it happened, you are now dealing with stitches and an owner who says the dog has never done this before.

In California, that last part does not matter, and we will explain why when you call. As your Orange County dog bite attorney, we identify the owner and the insurance, get the bite report from the right agency, and check whether a public entity is involved.

We represent clients across Orange County from our Los Angeles office on San Vicente Boulevard, with consultations by phone or video. Call (424) 465-2500 for a free consultation. No fee unless we win.

Orange County Dog Bite Lawyer Guide: Who Takes the Bite Report Where You Live

Orange County does not have one animal control agency. Which one holds your bite report, and the dog’s history, depends on the city where the bite happened. That file is often the first evidence we request. Cities not listed below use their own provider; check with your city or call us.

Where the bite happenedAgency that takes the report
Anaheim, Brea, Cypress, Fountain Valley, Fullerton, Orange, Huntington Beach, Lake Forest, Los Alamitos, Tustin, Placentia, Yorba Linda, San Juan Capistrano, Villa Park, and unincorporated areasOC Animal Care, a County of Orange agency
IrvineIrvine Animal Services, part of the Irvine Police Department
Santa AnaAnimal Services, under the Santa Ana Police Department
Mission Viejo, Aliso Viejo, Laguna Niguel, Laguna Hills, and Rancho Santa MargaritaMission Viejo Animal Services
Newport BeachThe Newport Beach Police Department’s Animal Control Unit
Costa MesaCosta Mesa Animal Control

OC Animal Care states that the law requires any bite or scratch from an animal to be reported, and it takes reports by phone at (714) 796-6421 and through a bite reporting form. Under the county code, a person who knows of a bite must report it to OC Animal Care immediately (Orange County Codified Ordinances 4-1-62), and according to OC Animal Care, an animal involved in a bite is generally quarantined for 10 days.

Report the bite even if the owner is a friend or a neighbor. The report confirms who owns the dog and can show that it has bitten before.

Strict Liability and Leash Rules: The Law Behind an Orange County Dog Bite Claim

Civil Code 3342 makes a dog’s owner liable for a bite that happens in a public place or while you are lawfully on private property, including the owner’s own home. You do not have to prove the owner was careless, and the dog does not get a free first bite.

Local leash rules matter for a different kind of case. When a dog knocks down a jogger or chases a cyclist into a fall, there is no bite, so the claim rests on negligence. The rule the owner broke becomes the proof.

PlaceRuleWhy it matters to your claim
Unincorporated county areasA dog on public property must be restrained by a substantial chain or a leash no longer than six feet (County ordinance 4-1-45)A loose dog, or one on a long retractable lead, shows the owner fell below the standard
County regional parksOC Parks requires all pets to be on a leash that does not exceed 6 feetTrail and picnic-area knockdowns
Costa MesaThe city requires a leash of six feet or shorter, with an exception inside the Costa Mesa Bark ParkBites and knockdowns on sidewalks and in neighborhood parks
Huntington Beach city beachThe City’s beach rules state that dogs must be leashed and are permitted only on the service road and at Dog BeachBites on the sand outside those areas

Off-leash areas such as Central Bark in Irvine or the Costa Mesa Bark Park do not suspend Civil Code 3342. An owner is still strictly liable for a bite inside the fence, though the insurer will look for provocation. Our Los Angeles dog bite page covers the defenses, the landlord cases, and non-bite injuries in depth, and our guide explains who is liable for injuries caused by dog bites.

The county code also lets a dog be declared “potentially dangerous” or “vicious” (sections 4-1-23 and 4-1-95). If the dog that bit you already carried one of those labels, the owner knew the risk. That can also support a claim against a landlord who allowed the dog to stay.

Police Dogs, County Shelters, and City Dog Parks: When a Public Agency Is Involved

Some bite cases in Orange County run against a public entity, and those start with a written claim presented within six months of the bite under Government Code 911.2.

  • A police or Sheriff’s K-9. The Orange County Sheriff’s Department runs a Canine Services Section whose K-9 units work across the county. Under Civil Code 3342(b) and (c), an agency is protected when its dog bites a suspect during police work, but that protection does not reach a bystander who had nothing to do with the incident. A claim over a Sheriff’s K-9 goes to the Clerk of the Board of Supervisors, 400 W. Civic Center Drive, 6th Floor, Santa Ana. A city police K-9 bite is a claim against that city, presented to its city clerk.
  • A dog in a shelter’s custody. OC Animal Care is a county agency, so a bite by a dog it was holding points to the County.
  • A broken gate or fence at a public dog park. If a city knew its enclosure would not hold dogs, a dangerous condition claim under Government Code 835 may exist alongside the claim against the owner.

One limit applies. Under Government Code 818.2, an agency is generally not liable for failing to enforce a law, so animal control’s failure to act on an earlier complaint is usually not a claim by itself. The owner remains responsible. For the steps in any agency case, see what to do if you have been injured due to a government entity.

What Your Dog Bite Claim Can Recover

Most bite claims are paid by the owner’s homeowner’s or renter’s insurance, so we get the policy itself, including any breed or animal exclusion, before we talk numbers.

Economic damages cover the emergency room, wound care, rabies treatment where the dog’s vaccination status is unknown, surgery, scar revision, therapy, counseling, and lost income. Non-economic damages cover pain, permanent scarring, and the fear that follows an attack, which in children can last years.

How We Handle a Dog Bite Case for Clients in Orange County

  1. Free consultation. We listen and tell you honestly whether there is a claim worth pursuing.
  2. The animal control file. We request the bite report, quarantine record, and any earlier complaints from the agency that covers the city where you were bitten.
  3. Owner and coverage. We identify the owner, anyone else keeping the dog, the landlord if the owner rents, and every policy that may pay.
  4. Agency check. If a K-9, a shelter, or public property is involved, we prepare and present the government claim inside six months.
  5. Medical proof. We document wounds as they heal, scarring, and psychological injury, and project future surgery with your doctors.
  6. Negotiation, then court if needed. Most claims settle. If the offer does not reflect the harm, we file in the Superior Court of California, County of Orange, whose Central Justice Center in Santa Ana hears unlimited civil cases. A settlement for a child generally needs a judge’s approval.

    Frequently Asked Questions

I was bitten in Irvine. Do I report it to OC Animal Care?

There is no fixed timeline. A personal injury claim with clear fault, finished treatment, and enough insurance may reach settlement in No. Irvine Animal Services, part of the Irvine Police Department, investigates bites and starts quarantines there. OC Animal Care covers its contract cities and unincorporated areas.months. A disputed case that has to be filed in Orange County Superior Court, go through discovery, and reach mediation or trial usually takes well over a year. Serious injury claims often take longest, because settling before the long-term prognosis is known risks leaving future care unpaid. How long a personal injury case takes in California.

The dog was off leash in a county regional park. Does that change my case?

It helps. Strict liability already applies to a bite, leashed or not. But OC Parks requires a leash of no more than six feet, so a loose dog also supports a negligence claim, which is what you need if the dog knocked you down without biting.

A police K-9 bit me while officers were chasing someone else. Can I bring a claim?

Possibly. The police dog exception in Civil Code 3342(b) and (c) does not cover a person who was not a party to or suspected of the conduct that led to the dog's use. A written claim must reach the city clerk for a city police dog, or the County's Clerk of the Board for a Sheriff's K-9, within six months.

My child was bitten at a neighbor's house in Anaheim. Who pays?

Usually the neighbor's homeowner's or renter's insurer, not the neighbor's own savings. Report the bite to OC Animal Care, which covers Anaheim, and let us deal with the insurance company.

What does an Orange County dog bite attorney cost?

The consultation is free, and our fee is a percentage of the recovery agreed in writing first. No fee unless we win.
