If you were hurt in an Uber or Lyft crash in Orange County, as a passenger, driver, pedestrian, or cyclist, Ravan Law can help. As your Orange County Uber accident attorney, we find out what the driver’s app was doing at the moment of impact, because that decides which policy pays.

Orange County Rideshare Accident Lawyer Guide: Where Uber and Lyft Crashes Happen Here

Rideshare trips here gather around a handful of places, and each one decides who takes the report and who holds the evidence.

John Wayne Airport

John Wayne Airport is owned and operated by the County of Orange. The airport allows Uber, Lyft, and Wingz to pick up passengers on the top level of parking structures A2 and B2, and in the Terminal C parking structure on the upper level next to the ticketing area. Drivers looking for a rider inside a parking structure, with luggage being loaded beside moving cars, is where impacts and door strikes happen. Law enforcement on airport property is handled by the Orange County Sheriff’s Department through its Airport Police Services Bureau. A claim about the airport’s own roadway or structure is a claim against the county.

The Anaheim resort district and the stadium area

Theme park closing time, a convention letting out, and a game or concert ending all send riders to the curb at once. Honda Center and the ARTIC transit station are both owned by the City of Anaheim. Crashes on Anaheim streets are reported to the Anaheim Police Department, which has its own process for traffic collision reports.

South Coast Plaza and the freeways between

Shopping centers such as South Coast Plaza in Costa Mesa keep video that may be overwritten within days. Longer trips use the 405, the 5, the 55, and the 73 toll road, where the California Highway Patrol takes the report through its Santa Ana, Westminster, or Capistrano area office.

Wherever it happened, screenshot the trip screen and save the receipt email. Your own screenshots are often the cleanest proof of when the ride began.

Rideshare Insurance After SB 371: Which Policy Pays for an Orange County Uber Crash

Under Public Utilities Code 5433, coverage depends on the driver’s app status. SB 371, effective January 1, 2026, cut passenger UM/UIM coverage to $60,000 per person and $300,000 per incident. Here is how it applies to you:

Your situationDriver’s app statusCoverage
An Uber driver heading home with the app off hits your carApp offThe driver’s personal auto insurance only
A Lyft driver circling for a ride request hits you in a crosswalkApp on, no ride accepted$50,000 per person and $100,000 per incident for bodily injury, $30,000 property damage, plus a $200,000 excess policy
Your driver runs a light on the way to the airportRide accepted, driver at fault$1,000,000 third-party liability
An uninsured driver hits the Uber you are riding inPassenger in the vehicleUM/UIM coverage of $60,000 per person and $300,000 per incident, from entering the vehicle to exiting it

The last row is the gap. Before 2026 that coverage was $1 million. If four people in one car are injured by an uninsured driver, the $300,000 is divided among all of them. We look for every other source: the at-fault driver’s own policy, the uninsured motorist coverage on your own auto policy, and any other party that shares fault.

Uber and Lyft drivers are independent contractors under Proposition 22, so a claim usually runs against the driver and the rideshare policy. A direct claim against the company may be possible where its own conduct contributed, and the rider terms may send that claim to arbitration. Our main page on Uber and Lyft accident claims covers this in depth, and we compare Lyft accident vs Uber accident claims separately.

Pedestrians and cyclists at the pickup point

Drivers must yield in marked and unmarked crosswalks (Vehicle Code 21950), and no one may open a car door into traffic unless it is reasonably safe (Vehicle Code 22517). In a “dooring” crash at a drop-off, the passenger, the driver who stopped in the lane, or both may be responsible.

Orange County Uber Accident Lawyer: When the Airport, an OC Bus, or a City Street Is Part of the Crash

Some rideshare crashes are government cases. An OC Bus pulls out into the Lyft you are riding in. A signal on a city street is dark. A roadway at the airport is poorly marked.

Each of those needs a written claim to the right public entity within six months of the injury, before any lawsuit (Government Code 911.2). The two-year deadline does not extend it.

  • John Wayne Airport and county roads: the Clerk of the Board of the County of Orange.
  • OC Bus: OCTA Risk Management. OCTA’s own claim form states the six-month limit.
  • City of Anaheim streets and city-owned venues: the Office of the City Clerk, 200 S. Anaheim Blvd., Suite 217. Other cities publish their own forms.
  • State highways: Caltrans takes claims of $12,500 or less at its district claims office, and claims over $12,500 go to the State’s Government Claims Program at the Department of General Services.

Our guide on what to do if you have been injured due to a government entity walks through the process.

What Your Rideshare Accident Claim Can Recover

Economic damages: hospital and surgical care, rehabilitation, future treatment, lost wages, and lost earning capacity. If you were visiting and went home to treat, we collect those records too.

Non-economic damages: pain, anxiety and post-traumatic stress, disfigurement, and the loss of the life you had before.

What moves the value is the severity of the injury, the driver’s app status, which policies apply, and how many injured people share them.

Deadlines for an Orange County Uber Accident Claim

ClaimDeadlineAuthority
Lawsuit against a driver or companyGenerally 2 years from the injuryCode of Civil Procedure 335.1
Claim against the county, OCTA, a city, or the State6 months from the injuryGovernment Code 911.2
Application to present a late claimA reasonable time, not more than 1 year, and relief is not automaticGovernment Code 911.4

Negotiating with Uber’s or Lyft’s insurer does not stop either clock. If your child was hurt, the two-year deadline is generally tolled until 18, but the six-month government claim is not paused, although late-claim relief may be available (Government Code 911.4, 911.6).

How We Handle an Uber Accident Case for Clients in Orange County

  1. We pin down the app status. We request trip records, app logs, GPS data, and in-app messages in writing, and pair them with your screenshots.
  2. We secure video from the shopping center, hotel, venue, or parking structure where the pickup happened.
  3. We get the report from the Sheriff’s Airport Police Services, city police, or the CHP.
  4. We map every policy and every injured person drawing on it.
  5. We present any government claim inside six months.
  6. We negotiate, and file suit if the offer is not fair, in the Superior Court of California, County of Orange. Its Central Justice Center in Santa Ana hears unlimited civil cases.

    Frequently Asked Questions

I was visiting Orange County and I live in another state. Can I still bring a claim here?

Yes. An injury case can generally be filed where the injury happened (Code of Civil Procedure 395). We work with you by phone and video, so you do not have to travel to start your claim.

My Uber was hit inside the pickup area at John Wayne Airport. Who do I claim against?

Start with the drivers: the at-fault driver's insurer, and the rideshare policy if your own driver was at fault. If the layout or condition of the structure contributed, the airport belongs to the County of Orange, and the six-month claim goes to the Clerk of the Board.

The driver had dropped me off and I was hit getting out. Am I still covered as a passenger?

The passenger UM/UIM coverage runs from entering the vehicle to exiting it, so the exact moment matters. We compare the trip end time in the app data with the time of impact.

An OC Bus hit my Lyft. What changes?

The deadline. OCTA is a public agency, so a written claim must be presented within six months before any lawsuit.
